Terms & Conditions of Your Stay

Guest Short Stay agreement for all short stay properties

This contract sets out the terms upon which RHJ Stays Ltd (“The Agent”) will provide a serviced apartment or house to you as set out on the booking form (“Accommodation”).

This contract is between the person who is the signatory to this Agreement (“You”) and RHJ Stays Ltd.

1. Booking Confirmation

To reserve Accommodation with RHJ Stays Ltd we require 100% of the total amount due. This amount is refundable as long as more than 14 days before your arrival you notify us that you no longer require your booking. For bookings made within 14 days of arrival, full payment, by cleared funds, is required at the time of booking. In the event of a cancellation within this period no refund will be given. If booking by telephone, once
RHJ Stays Ltd has confirmed acceptance of your payment details; or if booking via our website or email and the requested apartment is available, once you receive
confirmation by email of your booking, your booking is then booked. Should payment not reach RHJ Stays Ltd within the required time stated, RHJ Stays Ltd reserves the right to cancel any booking made and any money paid will be forfeited. Failure to pay in accordance with the agreed terms of payment may result in the suspension of Accommodation. RHJ Stays Ltd reserves the right to charge interest on overdue accounts.

2. Method of Payment

RHJ Stays Ltd accepts the following methods of payment:

• Credit/Debit Card: Visa,
Visa Debit, Mastercard, Mastercard Debit, Maestro, Solo, Visa Electron, Visa
Purchasing

• Bank Transfer: Pounds sterling. Bank details are available on request.

3. Booking Extensions

If you wish to extend your stay we will accommodate the request should we have availability. Payment must be made immediately on invoice. Failure to do so will result in a cleaning being scheduled for the original day of check out.

4. Accommodation

You are only granted a licence to occupy the Accommodation for the duration of your booking and this agreement gives you no other rights either express or implied to the Accommodation.

5. Occupancy

The number of people permitted to occupy each apartment is limited to the number of beds. In some properties, extra sleeping accommodation can be arranged. If the number of people permitted to occupy a property is exceeded, RHJ Stays Ltd reserves the right to charge for additional guests at the rate of £100 per guest per night or additional guests will have to vacate the property.

6. Duty of Care/Responsibility

It is the responsibility of the Guest to ensure they are respectful to other people staying within the building/area in which they are staying. Guests must also ensure noise levels are restricted. All properties are fitted with noise monitoring equipment, which does not record sound but measures the decibels within the property. Guests must not tamper with or cover or remove this equipment. Reports of excess noise from other people staying within the building/area in which they are staying, to RHJ Stays Ltd, will mean automatic immediate termination of the stay. In addition, Guests have a responsibility and duty of care to ensure damage is not deliberately inflicted on the property or its contents. Smoking is prohibited and any evidence of this in the apartment will incur penalties. Such damages will be charged to the Guest via invoice payable within 7 working days. Guests are not permitted to use the property for any illegal or unsavoury activity such as selling or taking drugs or sex work.

7. Arrivals and Departures

Guests can check in to their apartment from 4 pm on the day of arrival. On arrival, you will be asked to check the Accommodation and accept your stay. Check-out is at 10 am on the day of departure. Please note you will be charged £250.00 for checking out late. Key collection details will be provided prior to the check-in date and will not be released until this contract has been signed and identification of the lead guest submitted.

Early Departures – in the event that a guest needs to check out prior to the agreed departure date, RHJ Stays Ltd will class the departure as the end of the stay and arrange for the property to be cleaned.

8. Inventory / Property

All damages will be paid for by the guest within 7 days of receiving the invoice from RHJ Stays Ltd. Failure to do so will result in a small claims court claim being filed on the next working day after the deadline. All interest, legal fees, and other charge related to recouping the outstanding debt will be paid for by the guest.

9. Additional Charges

Broadband: Broadband is available free in all property locations. Passcodes will be provided on check-in. However, RHJ Stays Ltd will not be responsible for any fault
associated with the user’s hardware or software and no support will be available and RHJ Stays Ltd will not provide compensation in any form for its failure to work.

Cleaning: RHJ Stays Ltd expects the property to be left in a reasonable state on departure. If, at RHJ Stays Ltd’s discretion, additional cleaning is required on
departure, the cost of this cleaning will be an additional charge, again invoiced and payable within 7 days.

Smoking: Smoking is prohibited in all apartments and communal areas. In July 2007, smoking was made illegal in enclosed public areas; this includes the communal
hallways as they are used by all residents and their guests. Anyone found to be smoking or evidence of smoking in the apartments or communal areas will incur a
£250 charge by way of Liability to cover the additional costs of cleaning, freshening and airing the Apartment over a 24 hour period. Any damages caused will be charged for in addition to this fee, again invoiced and payable within 7 days.

Keys: RHJ Stays Ltd will issue the guest with one set of keys. Additional sets can be supplied subject to availability and the request must be made in advance of arrival.
However, if the issued keys are not returned on departure, we reserve the right to charge the guest or booker to replace keys or change the locks. The cost of
replacement keys will be £100.00 plus VAT and £150.00 plus VAT for garage fobs. The cost for replacing the locks will be no less than £100.00 plus VAT whichever RHJ Stays Ltd deems the quickest way of gaining access to the apartment. In such an event, RHJ Stays Ltd also reserves the right to charge the guest for further nights stay should it be the case that we are unable to gain access to the property.

Parking Pass: RHJ Stays Ltd will issue the guest with a parking pass (for those properties requiring permits only) which must be left in the apartment/key folder upon
departure. Failure to return the pass will result in a replacement charge of £150.00.

10. Liability

RHJ Stays Ltd cannot be held responsible in any way for loss of or damage to contents, furniture, fittings or any personal belongings at the apartment locations. Nor
can RHJ Stays Ltd be held liable for the acts or defaults caused by third parties. You are advised to ensure your own insurance policies cover loss or damage to personal property during your stay. Guests are advised to take out adequate travel and personal insurance. Some properties advertised on the RHJ Stays Ltd website are owned by third parties. Whilst RHJ Stays Ltd endeavours to ensure the highest standards for
third-party properties, it does not warrant that in booking these properties on your behalf, that the property is in accordance with local national laws including health and safety and insurance. You also understand that although a third party may comply with local national laws, the rights and remedies under such laws may be different from that of England and Wales. Nothing in this contract seeks to exclude liability for death and personal injury or any other liability not excludable under the laws of England and Wales.

11. Access to Properties

In addition to the regular housekeeping service, RHJ Stays Ltd on occasion may need to access the property in which you are staying. RHJ Stays Ltd reserves the right to gain access to all properties at all times. We will, wherever possible, endeavour to give guests as much notice as possible before entering the apartment.

12. Pets

RHJ Stays Ltd regrets that pets are not allowed in the apartments.

13. Services

RHJ Stays Ltd cannot be held responsible for any failure or interruption of services to the property, including electricity, gas, and water or any damage, disruption or noise caused as a result of repair works being carried out in another part of the property or development.

14. Communication

RHJ Stays Ltd operates between the hours of 9 am and 8 pm 7 days a week. If you are checking in after these times please call ahead during office hours to ensure you have everything you need. Please ensure you have provided your photo ID and agreed to the contract before your arrival and within office hours otherwise the lockbox code will not be released to you and you will be unable to check in to the property out of hours.

15. Charges

Depending on the source of your booking you may or may not be asked to pay a security deposit. In either case the lead guest takes full responsibility for any damage
or additional charges and accepts that they will be the named person on the invoice and the liability to pay rests solely with them. The lead guest also agrees to settle the invoice within 7 days and accepts that failure to do so will result in interest charged at 8% per day for every day that passes that the invoice is unsettled, plus any fees incurred to recover the debt. The initial damage will be deducted from any deposit held on file and you give full authorisation for this to happen whilst accepting that anything not recovered by the deposit amount will be paid in full by you, the lead guest, within 7 days of the invoice being issued.

16. Entire Agreement

This Agreement shall be governed by the laws of England and Wales and the Parties submit to the exclusive jurisdiction of the English Courts and the Apartment Form is the Guest Signature complete and exclusive statement of the Agreement between the parties relating to the subject matter of the Agreement which supersedes all previous communications, agreements or other arrangements written or oral. It expressly agrees that no variation of this Agreement shall be effective unless in writing and signed by a duly authorised signatory of both parties.

GUESTS FOUND CHECKING IN EARLY WITHOUT AUTHORIZATION MAY BE SUBJECT TO ADDITIONAL CHARGES

PLEASE MAKE SURE YOU ARE CHECKED OUT BY 10:00 am AT THE LATEST FOR CLEANING.

Check-in is strictly from 4:00 pm for all guests unless prior approval has been agreed with us.
